Introduction

Welcome to My Water Closet ("we," "our," "us"). By accessing or using our platform, you agree to comply with and be bound by these Terms & Conditions ("Terms"). This End-User Agreement governs the relationship between the user ("Enjoyer") and the provider ("Provider"), collectively referred to as "Parties."

Acceptance of Terms

By using My Water Closet, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our services. The effective date of these Terms is March 18, 2025.

1. User Rights and Responsibilities

• Access and Use: Users are granted a non-exclusive, revocable right to access and use the Website for its intended purposes, in compliance with this Agreement.
• Prohibited Activities: Users must not engage in any unlawful activities or misuse on the Website, including attempting unauthorized access, distributing malicious content, or infringing on intellectual property.
• Accuracy of Information: Users are responsible for providing accurate information when creating accounts or interacting with Providers on the Website.

2. Provider Rights and Responsibilities

• Service Availability: The Provider will make reasonable efforts to ensure the availability and reliability of the Website but is not liable for interruptions or technical issues beyond its control.
• Content Ownership: All content provided by the Provider on the Website is the intellectual property of My Water Closet and is protected by applicable laws.
• Data Protection: The Provider is committed to protecting Users' personal information in accordance with applicable privacy laws. For details, refer to our Privacy Policy.

3. Payment Terms

• Payment Processing: My Water Closet accepts payments exclusively through Stripe. Users are required to use Stripe for all financial transactions related to the Website.
• Commission: My Water Closet will take a 20% pretax commission on every transaction processed through the Website.
• Payment to Users: If applicable, payments to Users will be processed through the Stripe app or mailed via check, as determined by the Provider.
• Fees and Refunds:
  • Guest Refund Policy: If a guest experiences issues such as the property not being as described, they may be eligible for a refund under My Water Closet's Guest Refund Policy. This includes cases where the property is unsafe or inaccessible.
  • Host Cancellation Policies: Hosts can cancel without notice; the full amount of refund will be given back to the user if the host cancels.
  • Extenuating Circumstances: My Water Closet may provide refunds or allow cancellations without penalties in situations involving unforeseen events, such as natural disasters or serious illness.

4. Limitation of Liability

• The Provider is not responsible for any damages, losses, or disruptions resulting from the use or inability to use the Website. The Provider is also not responsible for any damage to property or injuries that may occur to either party while using the Website.
• The Provider does not guarantee uninterrupted or error-free operation of the Website and reserves the right to modify, suspend, or discontinue the Website without prior notice.
• The enjoyer shall be held responsible for any damage, harm, or loss caused to the Provider's property by their actions, whether such actions are intentional, negligent, or accidental.

5. Termination

• The Provider reserves the right to terminate User access to the Website at any time, with or without cause, and without prior notice.
• Users may terminate their use of the Website by ceasing access and notifying the Provider of their intent to terminate.

6. User Conduct

Prohibited Activities

• Engaging in illegal activities.
• Providing false or misleading information.
• Harassing or harming other users.
• Unauthorized access to our systems.
• Recording or taking photos in the bathroom, especially while a user is present.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States of America.

8. Amendments

The Provider reserves the right to modify this Agreement at any time. Users will be notified of material changes through the Website. Your continued use constitutes acceptance of the updated Terms.
